David Boies And Theodore B. Olson, Bipartisan Gay Marriage Lawyers, Land Book Deal

NEW YORK -- The bipartisan legal team leading the fight for gay marriage has a book deal.

Democrat David Boies and Republican Theodore B. Olson have signed with Viking for "A Just Cause: Law, Love, and the Case for Marriage Equality." Viking told The Associated Press on Wednesday the book is scheduled for mid-2014.

"Our collective journey tells of a crucial and historical civil rights movement that brings us closer to the ideals on which our country was founded," Boies, 71, said in a statement issued by Viking.

Olson, 72, said he and Boies between them have "nearly 100 years in the law."

"We have never handled a more important, dramatic and emotionally compelling challenge," he said in a statement.

Boies and Olson have formed an unlikely partnership to represent the challengers to Proposition 8, approved by California voters in 2008. The ballot initiative overturned a state Supreme Court decision allowing gay marriage. Justices on the U.S. Supreme Court will hear arguments in the California case on March 26.

Boies and Olson were on opposite sides for one of the court's most historic cases, when Boies represented Democratic presidential candidate Al Gore and Olson represented Republican George W. Bush in a dispute over the Florida vote count in 2000. The court ruled 5-4 in Bush's favor.

Viking, an imprint of Penguin Group (USA), promised the Boies-Olson book will be a "dramatic, intimate, and informed account of this historic issue."

Protests mark anniversary of Trayvon Martin's shooting death

SANFORD, Fla./NEW YORK (Reuters) - Demonstrators symbolically wearing hoodies gathered in New York, Florida and California on Tuesday to mark the anniversary of the shooting death of unarmed black teenager Trayvon Martin, reviving a national discussion on gun laws and racial profiling.

Actor Jamie Foxx joined Martin's parents and several hundred protesters for a candlelight vigil in New York City's Union Square, while a smaller crowd estimated at 110 to 125 met at a park in the Florida town where Martin died, vowing to continue to agitate for an end to racial discrimination.

"We want you (to) know we love you and we won't leave you," Foxx told Martin's mother, Sybrina Fulton, in New York.

Neighborhood watch volunteer George Zimmerman shot and killed Martin, 17, in the Orlando suburb of Sanford on February 26, 2012, and initially went free based on his claims of self defense. Then a national outcry forced the city's police chief to resign and the governor to appoint a special prosecutor.

Zimmerman now faces second-degree murder charges and a June trial. He has maintained his innocence, and supporters say he has been unfairly tainted as racist, noting the neighborhood had been hit by a wave of break-ins and that Zimmerman is of mixed race - his father is white and his mother Afro-Peruvian.

In Sanford, the case triggered deep emotions, and protesters staged a candlelight vigil and moment of silence at 7:15 p.m., the time Martin was killed, at Fort Mellon Park.

"There are no excuses for violence against our children. Let us take the tragedy of Trayvon's death and use it for good," said organizer Geri Hepburn, a white parent of a teenage son who became politically active as a result of the shooting.

The crowd was small compared to the thousands who filled the same park at the apex of public outrage of the killing last year, when the story dominated national news for weeks.

SYMBOLIC HOODIES

In New York, demonstrators recreated the "Million Hoodie March" of last year, when people wore hooded sweatshirts in the style worn by Martin the night of his death, when Zimmerman called police to report a suspicious looking person in his gated neighborhood and defied a police admonishment not to follow him.

The coast-to-coast series of events also saw a crowd gather in the Leimert Park section of Los Angeles. Participants carried lit candles and many of them also wore hoodies, said organizer Najee Ali, who spoke at the gathering in Los Angeles.

"Trayvon was everyone's son. He belonged to all of us," Ali said in a phone interview.

Martin was on his way home to the house of his father's girlfriend, and the hoodie became a symbol of what critics considered racial profiling.

"We are all Trayvon Martin," demonstrators chanted at Tuesday's vigil.

James Flood, 33, a black bartender and screenwriter, said he was constantly the victim of racial profiling and wanted better for his 11-year-old son.

"My skin color cannot change no matter how much money I make. I still get profiled," Flood said. "It has to stop."

Zimmerman, 29, who was released on bail, remained out of sight on the anniversary.

Thrust into the national spotlight, Martin's grieving parents, Fulton and father Tracy Martin, have become national advocates for stricter gun control laws and critics of Florida's Stand Your Ground law.

The law, passed in 2005, allows people to use lethal force in self defense if they are in fear of serious bodily harm. More than 20 states have since passed similar laws.

Police cited that law in initially declining to arrest Zimmerman, which sparked celebrity protests and popular demonstrations across the country, turning the case into an international story.

Zimmerman's attorney plans to invoke the Stand Your Ground law at an April 29 hearing at which a Florida judge could determine if the law applied to Zimmerman, possibly granting him immunity and averting a criminal trial.

Shortly before noon, before the vote on whether to move forward on Chuck Hagel?s nomination for secretary of defense, Kentucky Sen. Rand Paul walked onto the floor of the Senate. He stood near the well, where he would have to cast his vote. After Tennessee Sen. Lamar Alexander cast the first vote?an aye?he and Paul chatted off to the side. When his own name came up in the roll call??Mr. Paul???Paul said nothing.

Nearly half of Paul?s fellow senators voted in the first alphabetical run-through of names. It was clear, almost immediately, that Hagel would have enough votes to break a filibuster. Paul walked over to Texas Sen. Ted Cruz, the unofficial whip of the unofficial Dump Hagel campaign, spoke briefly, then returned to the well. He cast his vote.

Hagel was vaulting over this final hurdle, but Paul wasn?t going to help. Two weeks earlier, Paul had cast a decisive vote against cloture, making Hagel the first-ever national security nominee to face a filibuster. ?There's all kinds of rumors all over the Internet about foreign groups that may have provided financing,? explained Paul, ?and I think he needs to reveal that.? Had Paul voted the other way, Hagel wouldn?t have spent those extra days being beat up by hawkish Republicans, Washington Post blogger Jennifer Rubin, and groups like the Emergency Committee for Israel.

Forty other Republicans joined Paul on that first filibuster, and 26 more joined him in the first vote opposing cloture today. But conservative foreign policy ?realists,? the sort of people who backed Rep. Ron Paul?s campaigns for president, were uniquely disappointed in the heir. ?Sen. Paul is aiding and abetting a disgusting McCarthyite campaign against an honorable man,? wrote AntiWar.com?s Justin Raimondo. ?Paul endorsed one of the worst, least credible anti-Hagel arguments of all,? wrote American Conservative columnist Daniel Larison, ?which is essentially the Ted Cruz argument that Hagel needs to ?prove? that he is not in league with foreign governments or sympathetic with terrorists.?

Overcoming that kind of guilt-by-association politics was one of the points of the Hagel nomination. Wasn?t it? Rand Paul, too, had challenged the wisdom of the neoconservatives and been battered for it. If Hagel could be confirmed, it would mean you could name and shame the ?Israel lobby? (or, okay, the ?Jewish lobby?) without being banished to Siberia. If the Senate really debated Hagel?s views, really revisited the wisdom of the Iraq War and whether the 2007 surge worked and whether Iran can?t ever be negotiated with, it would expand the aperture of ?serious? foreign policy debate.

Paul was aware of that. To him, delaying Hagel was in keeping with the actual goals of the realists and libertarians. ?I wanted to get more information not only on Hagel but more information on [CIA nominee John] Brennan,? he said, after leaving the post-vote Republican luncheon. ?That didn?t work because we didn?t stick together on it. Last week?s vote was useless. If you don?t stick together, you won?t have leverage.? And Paul will now turn his attention to the Brennan nomination, to demand and get more answers on the legality of the drone program and whether Americans, on American soil, could be targeted for killing. ?It?s blatantly illegal?we have probably a dozen laws saying the CIA can?t operate in the United States, and neither can the Department of Defense.?

That wasn?t obvious to libertarians and paleo-conservatives. One year ago, Sen. Paul was criss-crossing key Republican primary and caucus states to whip up support for presidential candidate Ron Paul. I remember cranking the speedometer of a rental car, and parking illegally near the University of Northern Iowa, to see the Pauls work a fire-hazard-crowded ballroom. Ron Paul would go on to win that county. Rand Paul would go on to filibuster Chuck Hagel.

Horse meat in the US? Unlikely, but tests are rare - Vitals

Europe?s scandal over horse meat hidden in beef products -- including recalls of Nestle ravioli and Birds Eye chili con carne -- has renewed questions about whether Americans unwittingly could be eating equine products as well.

U.S. Department of Agriculture regulators say it?s highly unlikely that beef adulterated with horse meat could make it to the nation?s dinner plates because no domestic suppliers currently slaughter horses and the agency has strict labeling and inspection standards for imported meat.

But agency officials also acknowledge privately that species testing for meat imported into the U.S. is performed typically only when there?s a reason to question a shipment.

And a Florida company that supplies the only validated tests for horse meat in food has been slammed with nearly 1,000 requests in recent weeks for its $500 kits -- including orders from major U.S. meat producers.

?It?s becoming a little hectic,? said Natalie Rosskopf, administrative director of Elisa Technologies Inc. of Gainesville. ?There was no call for horse testing a month ago. Nothing.?

Continental Europe has been roiled recently by reports of horse meat masquerading as beef in frozen burgers and prepared foods, including frozen dinners and pastas. This week, Nestle announced it was removing chilled pasta products produced by a German supplier, including Buitoni Beef Ravioli and Beef Tortellini, from stores in Italy and Spain, and a lasagna product from France. On Friday, frozen food maker Birds Eye said it would withdraw products including chili con carne from Britain and Ireland because tests detected traces of horse DNA.

The trouble with horse meat hidden in beef is partly a health concern. Meats taken from store shelves in Britain and Germany had traces of a powerful equine painkiller, phenylbutazone, or ?bute,? which is banned in animals destined for human food, tests showed.

But it?s also about trust, especially in the U.S., where many shudder at the mere thought of eating horse meat and the deception would raise even more suspicion about a company?s practices.

?If a company is willing to commit fraud, I can?t imagine that food safety is the biggest thing on their agenda,? said Bill Marler, a Seattle lawyer and food safety expert who publishes a blog focused on the industry.

In fact, boneless beef adulterated with horse meat -- and with kangaroo -- did make it to the U.S. more than 30 years ago, when mislabeled meat from Australia led to the impounding and testing of 66 million pounds of the product, according to old USDA records found and posted by Marler.

Known as the ?Australian meat incident,? the beef substitution scandal prompted swift action and increased scrutiny by agency officials.

USDA officials couldn?t quickly produce records of species testing results in the past 30 years -- or even the past year -- but they say the possibility of that happening again is remote. The U.S. neither slaughters horses nor imports horse meat from other countries, and it doesn?t allow import of beef from the countries and companies involved in the European scandal, an official told NBC News. (He was speaking on background because he said he wasn?t authorized to discuss the issue.)

In addition, USDA inspectors look at every shipment of meat sent through U.S. ports and can demand species testing if anything is amiss, documents show.

Officials with the Food and Drug Administration, which oversees processed foods, said that they had detected no horse meat in imported or U.S.-made food.?

?We have no past record or current indication that horse meat is an ingredient in any FDA-regulated processed foods in the U.S.,? Jalil Isa, an FDA spokesman, said in an email. He added that FDA officials are reaching out to Nestle and Birds Eye to ensure that no adulterated food was sent to the U.S. Nestle has said no U.S. products use meat from European sources.

Birds Eye Iglo U.K. products have no connection to the Birds Eye brand in the U.S., which is owned by Pinnacle Foods, and isn?t affiliated with the U.K. supplier.

Producers such as the meat giant Cargill say they don?t import beef from plants that also slaughter horses, or from the companies and suppliers implicated in the European scandal, and they remain confident that their meat is free of adulteration.

?Cargill?s beef supply chain is shorter than those involved in the horse meat issue in Europe and we know, and work directly with, our suppliers, which minimizes the potential for fraudulent substitution of products,? Cargill spokesman Mike Martin told NBC News in an email.

Still, the problems in Europe could prompt renewed scrutiny, he added.

?We do not analyze for other species and are assessing the current situation to determine if this is something we might do in the future,? Martin said.

If they do, they?ll have to turn to Elisa Technologies for the horse species test, said Rosskopf. The company?s meat species kits, which verify animal proteins in raw and cooked meat samples, have been used for years by the USDA and by private firms, she said.

Before the discovery in Europe of horse meat in beef, the firm?s typical demand was for tests for more common species, for instance, to confirm that no pork was present in kosher meat, Rosskopf said. Now, meat suppliers mostly in Europe, but also in the U.S., have been clamoring for the equine test.

Have there been any positive tests so far?

?I can?t say,? said Rosskopf, noting that the company is known for its adherence to confidentiality agreements.

Of course, putting horse meat on the dinner table is common in many countries, including France, Canada, Mexico and Japan, to name a few. And it?s not unheard of on American menus, either. Slaughterhouses that produced horse meat for human consumption were in operation in the U.S. until 2007, when the last three of a one-time high of 16 or 17 plants closed under state and federal pressure.

Congress effectively banned the practice then by refusing to fund USDA inspections of the slaughterhouses. Those efforts were fueled by vocal anti-slaughter activists who regarded the practice as inhumane.

The arrangement stayed in place until 2011, when the Obama administration quietly lifted the restriction, partly out of concern for the neglect of horses in the U.S. and the treatment of horses that were shipped to Canada and Mexico to be killed.

The U.S. exported more than 46,000 metric tons of horse meat in 1990, a figure that fell to about 5,600 metric tons in 2007, when the ban was enacted, industry figures show.

Wyoming state Rep. Sue Wallis is trying to reinstate horse slaughter in the U.S. and to build a new source for the meat in America and abroad.

Her application is among those pending with the USDA to open horse slaughterhouses in Missouri, Iowa and New Mexico. The firms would produce what she and other advocates call ?cheval,? horse meat that she said is prized by gourmet cooks and health enthusiasts for its taste and lean profile. Plus, Wallis said, horse meat is generally about 40 percent cheaper than beef.

?There are plenty of people in America who have no problem with cheval and are anxiously awaiting our product,? she said.

Oscar show promises music, megastars and James Bond

LOS ANGELES (Reuters) - Bigger stars, more music and edgier comedy are on the menu for Sunday's Oscar ceremony, when the most coveted awards in the movie industry are handed out during a glittering Academy Awards show.

Producers of the three-hour Oscar telecast at Hollywood's Dolby Theatre are promising a faster-paced show and more face time with first-time host Seth MacFarlane, while honoring the best films not just of 2012 but also of decades past.

"We have more performances on that stage than we can ever remember there being in the past. And we are not trotting people out just to sing and dance. Every single thing you see on that stage will be related to movies," said Craig Zadan, who is producing the Oscar telecast for the first time with Neil Meron.

"We have devised ways that we are hoping will make the pacing faster ... That doesn't mean we are not going to give as much weight to honoring the winners, but there has been a lot of dead space in the show (in the past)," Zadan told Reuters.

Steven Spielberg's presidential movie "Lincoln" heads into Sunday's ceremony with a leading 12 nominations, followed by Ang Lee's shipwreck tale "Life of Pi" with 11, French Revolutionary musical "Les Miserables" and romantic comedy "Silver Linings Playbook" with eight apiece, and Iran hostage drama "Argo" with seven.

All five are competing for Best Picture, the top prize, in a tight race that has narrowed in recent weeks to "Lincoln" or "Argo" and will be the last to be announced on Sunday night.

JAMES BOND AND MUSICALS

Before then, Zadan and Meron have assembled an array of performers and presenters that almost outshine the actors, actresses, directors and screenwriters who have been waiting since early January to see if they will go home with a golden Oscar.

They include A-listers Barbra Streisand, Jack Nicholson, Jane Fonda, John Travolta and Jennifer Aniston, along with younger stars Daniel Radcliffe, Kristen Stewart and Joseph Gordon-Levitt.

But don't count on seeing all six surviving James Bond actors on stage for the planned special 50th anniversary tribute to the British secret agent's illustrious movie career.

"We have a tribute to James Bond which is really exciting and thrilling, but it never included the concept of six guys coming out and standing there awkwardly on the stage," Zadan said, quashing speculation that Daniel Craig, Timothy Dalton, Pierce Brosnan, Roger Moore, Sean Connery and George Lazenby would unite on Sunday.

The nominations for "Les Miserables," where Anne Hathaway is tipped to win Best Supporting Actress, has opened the door to a celebration of the last decade of musicals.

The tribute will feature Hathaway, her Oscar-nominated co-star Hugh Jackman, as well as "Dreamgirls" and "Chicago" Oscar winners Jennifer Hudson and Catherine Zeta-Jones.

MacFarlane, the creator of provocative animated TV series "Family Guy," will also be showing off his vocal skills, and spending more time on stage than has been traditional for Oscar hosts.

"What happens a lot in the past is that the host comes on, talks for a lot, and then disappears for half an hour. We are not doing that. We are having Seth be there a lot, out there introducing things, and that allows for more pacing and comedy," said Zadan.

But there will be plenty of room for the unpredictable - and that's not even counting possible upsets when the winners' envelopes are unsealed.

"We love the fact that people don't quite know what they're going to get with Seth as a host," said Meron. "We live for the moments that happen on stage. Those are some of the great Oscar moments of the past."

The Oscar winners are chosen by some 5,800 movie industry professionals who are members of the Academy of Motion Picture Arts and Sciences.

The Academy Awards ceremony, in its 85th year, will be broadcast live on ABC television in the United States, and to more than 225 other nations.

Young adults have less debt according to Pew research study

GRAND JUNCTION, Colo. -

Young adults have less debt according to a recent Pew Research Study.

But is it because they're not buying anything?

The study released today shows that young adults under the age of 35 have less debt. The main reason is mainly because they own fewer assets such as cars and houses.

Young adults today say they're avoiding those major purchases after watching their parents struggle.

"I feel that our parents? generation are in debit, and personally, the reason why I don't have debt is because I've seen my parents struggle with it my whole life," said ?27 year old, Owland Mackey.

Mackey says he's thankful he learned to avoid debt at an early age.

And experts say he's not the only one.

Financial West Group Investment?Adviser,?Ford Keeler said, "I think they have seen what their parents and older folks have gone through with crises in their financial situation, and in large part young adults want to avoid that, and if they can, having a few less toys and assets I think they're willing to forego some of those things."

Mackey says his biggest asset, which he bought before the recession helps him avoid piling up bills.

"I was able to have an opportunity to purchase a house when I was young. It's really helped me out to be able to rent it, really one of the best choices I've made," explained Mackey.

Despite his purchase, a recent Pew Research Study shows younger households with any kind of debt dropped to 78% - the lowest level in 30 years.

Mackey says unlike him, his friends don't have any assets.

"It's kind of a fine balance, I think having assets having things that will spur on our local economy is one thing, but gaining the debt to obtain those items without a doubt is a negative," said Keeler.

The study shows the number of young adults with credit card debt is dropping as well.

And experts say that may be because it's harder for young people to get credit in the first place.

"I think banks have stiffened their lending requirements to a large extent, I think particularly young folks who don't have an established credit history, banks aren't as willing or able to lend money as they once were," said Keeler.

Still Mackey thinks as a young person you have to make a choice to stay out of debt.

"It's all about spending the money that you have. A lot of people with without their means, they max out their credit cards. And I just base my expenses on how much I make," explained Mackey.

MY TAKE:
I'm always interested in children's books that both entertain and help kids learn.

In Attack of the Chicken Nugget Man, Chris is a young boy who just can't seem to remember anything at school. With a standardized test coming up, how is he ever going to pass the test? And what is up with the mysterious Chicken Nugget Man?

As I was reading the first few chapters, I wasn't too impressed with what I was reading. The story is a little bit nutty and unlikely. The idea of the Chicken Nugget Man also wasn't explained. I thought it was a man dressed as a chicken nugget. As it turns out, the Chicken Nugget Man is actually a sentient chicken nugget.

However, as I continued reading and the story started to come together, the book actually wasn't too bad. Each chapter was short, like what you would actually find in a standardized test, and it had a short quiz after each chapter. There were also little drawings, representing underlined words, and knowledge nuggets that add a little more interactivity to the chapter.

THE GOOD:

What's striking is the absence of triumphalism -- Bigelow doesn't shy away from showing the victims shot down in cold blood in the compound -- and we come away with the overwhelming sense that this has been a grim, dark episode in our history.

Chastain makes Maya as vivid as a bloodshot eye. Her porcelain skin, delicate features and feminine attire belie the steel within.

No doubt Zero Dark Thirty serves a function by airing America's dirty laundry about detainee and torture programs, but in its wake, there's a crying need for a compassionate Coming Home to counter its brutal Deer Hunter.

While "Zero Dark Thirty" may offer political and moral arguing points aplenty, as well as vicarious thrills,as a film it's simply too much of a passable thing.

From the very first scenes of Zero Dark Thirty, director Kathryn Bigelow demonstrates why she is such a formidable filmmaker, as adept with human emotion as with visceral, pulse-quickening action.

A timely and important reminder of the agonizing human price of zealotry.

Bigelow's latest proves a rewarding piece of filmmaking, one that, in its best moments at least, is as gripping and as troubling as anything the director's ever made.

Bigelow and screenwriter Mark Boal shape history -- those breaks, big and small, that led to the killing of Osama bin Laden -- into one of the finest fact-based thrillers since "All the President's Men."

Purely as cinematic exercise, Zero Dark Thirty is an exhilarating piece of work. But, beyond its for-the-times subject matter, the work does not linger whatsoever.

Zero Dark Thirty is interesting as opposed to enjoyable, intriguing as opposed to entertaining, and certainly less memorable than The Hurt Locker.

It's quite remarkable how Bigelow and Boal managed to take 12 years of information (including a conclusion that everyone knows) and packaged it into a coherent, intimate and intense movie.

We know the ending, yet remain mesmerized by familiar details, filmed with a harrowing sense of urgency. It's as close to being in the White House situation room that night, watching a closed-circuit broadcast, as anyone could expect.

The second half of the film IS the film.

Whereas Locker was less about war than what it is to have a death wish, ZDT is less about the suspenseful true-life search for Osama bin Laden than the red tape one woman must wade through to prove that a mean old bastard is living in suburban Pakistan.

Bigelow's great achievement is stripping down the action from the exaggerated theatrics in movies and television shows so the missions feel no less exciting and immediate.

One of the finest movies of the year is a thriller about the tracking and, finally, slaying of Osama bin Laden.

There is no Team America-style, flag-waving bravado behind this story - it is quite the opposite.

Bigelow has created the best film of 2012.

"Zero Dark Thirty" is less a celebration how terrorist mastermind Osama bin Laden was found and killed than an engrossing examination of why it took a decade to deal with him.

Following on from the great acclaim of The Hurt Locker, Bigalow's shaky cam and tough talking characters once again take us to the dark side of modern warfare.

In the absence of cinematic grandeur and didacticism, we're left as empty and as lost as Chastain's agent as she boards a symbolically empty plane for an uncertain future. Just what are we to think of the so-called War on Terror?

The viewer needs to stay sharp to stay on top of the details of the labyrinthine search, but Bigelow tackles the complex story with the same muscular urgency and incisive intelligence that won her an Oscar for The Hurt Locker.

Exhilarating cinema that makes you want to forget all the questionable issues of representation that have come before it.

Fruit flies force their young to drink alcohol for their own good

Feb. 22, 2013 ? The fruit fly study adds to the evidence "that using toxins in the environment to medicate offspring may be common across the animal kingdom," says biologist Todd Schlenke.

When fruit flies sense parasitic wasps in their environment, they lay their eggs in an alcohol-soaked environment, essentially forcing their larvae to consume booze as a drug to combat the deadly wasps.

The discovery by biologists at Emory University is being published in the journal Science on February 22.

"The adult flies actually anticipate an infection risk to their children, and then they medicate them by depositing them in alcohol," says Todd Schlenke, the evolutionary geneticist whose lab did the research. "We found that this medicating behavior was shared by diverse fly species, adding to the evidence that using toxins in the environment to medicate offspring may be common across the animal kingdom."

Adult fruit flies detect the wasps by sight, and appear to have much better vision than previously realized, he adds. "Our data indicate that the flies can visually distinguish the relatively small morphological differences between male and female wasps, and between different species of wasps."

The experiments were led by Balint Zacsoh, who recently graduated from Emory with a degree in biology and still works in the Schlenke lab. The team also included Emory graduate student Zachary Lynch and postdoc Nathan Mortimer.

The larvae of the common fruit fly, Drosophila melanogaster, eat the rot, or fungi and bacteria, that grows on overripe, fermenting fruit. They have evolved a certain amount of resistance to the toxic effects of the alcohol levels in their natural habitat, which can range up to 15 percent.

Tiny, endoparasitoid wasps are major killers of fruit flies. The wasps inject their eggs inside the fruit fly larvae, along with venom that aims to suppress their hosts' cellular immune response. If the flies fail to kill the wasp egg, a wasp larva hatches inside the fruit fly larva and begins to eat its host from the inside out.

Last year, the Schlenke lab published a study showing how fruit fly larvae infected with wasps prefer to eat food high in alcohol. This behavior greatly improves the survival rate of the fruit flies because they have evolved high tolerance of the toxic effects of the alcohol, but the wasps have not.

"The fruit fly larvae raise their blood alcohol levels, so that the wasps living in their blood will suffer," Schlenke says. "When you think of an immune system, you usually think of blood cells and immune proteins, but behavior can also be a big part of an organism's immune defense."

For the latest study, the researchers asked whether the fruit fly parents could sense when their children were at risk for infection, and whether they then sought out alcohol to prophylactically medicate them.

Adult female fruit flies were released in one mesh cage with parasitic wasps and another mesh cage with no wasps. Both cages had two petri dishes containing yeast, the nourishment for lab-raised fruit flies and their larvae. The yeast in one of the petri dishes was mixed with 6 percent alcohol, while the yeast in the other dish was alcohol free. After 24 hours, the petri dishes were removed and the researchers counted the eggs that the fruit flies had laid.

The results were dramatic. In the mesh cage with parasitic wasps, 90 percent of the eggs laid were in the dish containing alcohol. In the cage with no wasps, only 40 percent of the eggs were in the alcohol dish.

"The fruit flies clearly change their reproductive behavior when the wasps are present," Schlenke says. "The alcohol is slightly toxic to the fruit flies as well, but the wasps are a bigger danger than the alcohol."

The fly strains used in the experiments have been bred in the lab for decades. "The flies that we work with have not seen wasps in their lives before, and neither have their ancestors going back hundreds of generations," Schlenke says. "And yet, the flies still recognize these wasps as a danger when they are put in a cage with them."

Further experiments showed that the flies are extremely discerning about differences in the wasps. They preferred to lay their eggs in alcohol when female wasps were present, but not if only male wasps were in the cage.

Theorizing that the flies were reacting to pheromones, the researchers conducted experiments using two groups of mutated fruit flies. One group lacked the ability to smell, and another group lacked sight. The flies unable to smell, however, still preferred to lay their eggs in alcohol when female wasps were present. The blind flies did not make the distinction, choosing the non-alcohol food for their offspring, even in the presence of female wasps.

"This result was a surprise to me," Schlenke says. "I thought the flies were probably using olfaction to sense the female wasps. The small, compound eyes of flies are believed to be more geared to detecting motion than high-resolution images."

The only obvious visual differences between the female and male wasps, he adds, is that the males have longer antennae, slightly smaller bodies, and lack an ovipositor.

Further experimentation showed that the fruit flies can distinguish different species of wasps, and will only choose the alcohol food in response to wasp species that infect larvae, not fly pupae. "Fly larvae usually leave the food before they pupate," Schlenke explains, "so there is likely little benefit to laying eggs at alcoholic sites when pupal parasites are present."

The researchers also connected the exposure to female parasitic wasps to changes in a fruit fly neuropeptide.

Stress, and the resulting reduced level of neuropeptide F, or NPF, has previously been associated with alcohol-seeking behavior in fruit flies. Similarly, levels of a homologous neuropeptide in humans, NPY, is associated with alcoholism.

"We found that when a fruit fly is exposed to female parasitic wasps, this exposure reduces the level of NPF in the fly brain, causing the fly to seek out alcoholic sites for oviposition," Schlenke says. "Furthermore, the alcohol-seeking behavior appears to remain for the duration of the fly's life, even when the parasitic wasps are no longer present, an example of long-term memory."

Finally, Drosophila melanogaster is not unique in using this offspring medication behavior. "We tested a number of fly species," Schlenke says, "and found that each fly species that uses rotting fruit for food mounts this immune behavior against parasitic wasps. Medication may be far more common in nature than we previously thought."

HTC settles with FTC over insecure implementation of Carrier IQ, HTC Logger

HTC America has settled with the FTC (Federal Trade Commission) over concerns that the company put millions of customer's personal information at risk with insecure implementations of software on its devices. The FTC found that HTC did not take a reasonable amount of care in implementing best coding and security practices when creating software for its devices, having this to say:

"[HTC] failed to provide its engineering staff with adequate security training, failed to review or test the software on its mobile devices for potential security vulnerabilities, failed to follow well-known and commonly accepted secure coding practices, and failed to establish a process for receiving and addressing vulnerability reports from third parties."

Those are some pretty strong words for the company, but where it really hits home is the consumer-facing issues that were caused by this lack of oversight. The FTC explains that HTC's implementation of Carrier IQ and HTC Logger on its devices left customer data vulnerable to attack, alongside errors that would let third parties bypass Android's built-in permissions system.

The second part of the FTC's complaint is that it finds HTC was deceptive in telling consumers about the security risks of its software implementations, stating that the device user manuals and interface of the "Tell HTC" app were misleading. Both of these issues in implementation are said to have undermined the normal consent mechanism of Android that would have kept user's data safe.

So what does this mean for HTC? The FTC is requiring that the company develop and release software patches for its devices that are affected with these vulnerabilities, and HTC has said that it has already released some patches at this point. Furthermore, HTC will have to submit to "independent security assessments" every 2 years for the next 20 years. HTC will also be forbidden from making misleading statements about the security of its devices and user's data going forward.

This is a pretty big finding from the FTC, but isn't necessarily uncommon. Although their may not have been widespread exploits that were taking advantage of these security holes, it's important that HTC is going to be making changes to help security going forward. Though we would have preferred if HTC was implementing best practices in the first place, rather than it coming to an investigation by the FTC.

Samsung's Galaxy models? Apple's iPhone 5? Or how about a Nokia or Motorola offering? According to FixYa, a community-based body that regularly breaks down gadgets and issues repair reports about consumer products, smartphones may be useful, but with the rapid product cycle and constantly changing expectations of consumers, problems can emerge with the hardware.

Most of us have preferences when it comes to smartphones and tablet models, whether you look for security and encryption, speed, battery life or camera features. However, no model is perfect -- FixYa finding that Motorola tends to bloat their products with unnecessary software, Samsung smartphones are dogged by microphone issues, Nokia has a "laggy" interface, whereas Apple's iPhone comes equipped with a number of battery issues.

Pitting Apple, Samsung, Motorola and Nokia head-to-head, the FixYa team have compared the Apple iPhone, Motorola Droid, Samsung Galaxy, and Nokia Lumia smartphone lines. The report says that Apple's iPhone is three times more reliable than its closest rival, Korean firm Samsung, as well as being 25 times more reliable than Motorola's Droid.

The information below compares the most persistent problems with each device. By combining and analyzing data from 722,558 combined problem impressions -- in other words, consumer problems which have been posted either through the organization's website or mobile app and then adding marketshare data from StatCounter, the "Smartphone Reliability Report" has assigned each manufacturer a reliability score, relative to their market share and reported gadget problems.

All in all, FixYa has given Apple a reliability rating of 3.47 and Samsung 1.21, whereas Nokia and Motorola fall behind with ratings of 0.69 and 0.13 respectively. The main trends for each smartphone model are documented below:

Apple dominated the reliability tests with the fewest number of problems in relation to the iPad and iPhone maker's estimated marketshare, although most were related to battery life. However, the interface, camera and app store still make sure that Apple remains a key favorite for smartphone users. A recent report?by Strategy Analytics which suggested the iPhone 5 managed to become the top selling model in Q4 2012.

Reports suggested that iPhone users enjoyed the "sleekness and simplicity" of the Apple interface, and although complaints cropped up, most technical issues rarely became a roadblock for longer than a week or so.?

However, many consumers still seeking ways to help conserve their iPhone's battery life, a complaint which took hold after the launch of the iPhone 4S. ?

Samsung, on the other hand, came in behind its rival with the second-highest reliability score. Users approved the Samsung Galaxy's interface across all models, but hardware issues including the microphone and speakers remained cause for complaint.

One element which raised very few complaints, however, was the battery life of Samsung Galaxy SIII smartphones, although the Samsung Galaxy Nexus performed far more poorly in this category. ?

Nokia, who was granted the third lowest reliability score, tended to be slower to load than other smartphone models, according to 35 percent of consumers. In addition, 20 percent of consumers were frustrated at the sparse application ecosystem with Windows Phone, although this is slowly improving. 15 percent of users reported failures when it came down to battery life, and 15 percent found that Nokia's Lumia smartphone sometimes becomes too hot.

However, Nokia uses did report that they appreciated the durability of the Nokia Lumia's screen, and the "Live tiles" feature on the homescreen was a great addition.?

Motorola has the lowest marketshare of these smartphone manufacturers and also was given the lowest reliability score. Users of Motorola products have been dogged by a plethora of issues -- with 136,436 problem impressions reported on FixYa -- ranging from the audio hardware to software. 30 percent of users reported problems with preinstalled apps, or "bloatware" which cannot be removed, 25 percent said they experienced issues with Motorola touchscreens, and 20 percent complained about speaker quality. In addition, 15 percent of users reported problems with the quality of Motorola's Droid camera.

However, Motorola shone in terms of battery life as well as the overall phone's design.?

"Smartphones are consistently being compared on a case by case basis, but no one has looked at the overall trends across a manufacturers? entire smartphone line," said FixYa CEO and founder Yaniv Bensadon. "The result is an accurate and fair method, and a scaled approach to fairly compare these top companies to truly see who is the most reliable, and who is barely even competing."

White House must respond to questions about cellphone unlock law ...

When the White House first launched its petition website, the goal was to create a direct medium of communication between government and the people. Petitions made a lot of sense as it was a great way to gauge which issues are most important to people. The White House promised to respond to any petition that reached a certain threshold before a certain amount of time.

The original threshold was set at 30,000 signatures, but because it was so easy for pranksters to get the White House to respond to a request to build a death star, the threshold was tweaked to 100,000. That made it more difficult to get discussion on real issues going, but we understand the need.

That said, the one petition us phone lovers really care about ? the one to make the unlocking of cell phones legal again ? reached the 100,000 mark just before the cut-off date.?The Librarian of Congress put into effect a rule that effectively banned the act of unlocking your phone without carrier consent. Most scoffed at the law and the idea that the government could scare citizens away using court fines and possible prosecution, but regardless of how you feel about the ridiculous nature of the enforcement or the law itself most would still rather it be done away with.

With this milestone reached, an official from the White House must respond to the request laid out in the original petition. That doesn?t necessarily mean the White House has to comply with the request, but we will at least get a nice, thoughtful response. And note that even if the White House officials agree with the movement, it?s not entirely up to them whether or not the law stays, goes, or is changed.

The best case scenario would be to see the new law rescinded by the Librarian of Congress at the request of the Obama administration. In other words, don?t get your hopes up just yet ? just be happy that we?ll even be able to get a real, meaningful response at all. We?ll keep our eye out for the update from the White House in the weeks to come.
